We think that it's tested after each man dies. Certainly it's always
the case that when a side does break, it's lost just over 50%, which
is not possible if it is tested at the end of rounds.

Given the above, that can't happen.

If the top noble in the stack has it, you never break. If the top
noble in the stack does not have it, you will break at 50%, even if
sub-nobles have it.
